A building permit is required for the construction of all retaining walls that are 1m or greater in height regardless of their location. A building permit may also be required for the construction of a retaining wall that is less than 1m high, if that retaining wall is associated with other building work or with protection of adjoining property.
In addition to protection works, some retaining walls that are less than 1m in height also require a building permit for construction if they are on or near site boundaries, if there is a risk of damage to the adjoining property.
