Amendment C108 - Ballan Precinct 5

Council has prepared Amendment C108 to the Moorabool Planning Scheme, at the request of request of Whiteman Property and Associates Pty Ltd on behalf of Wel.Co. 

The amendment is required to facilitate staged, masterplanned residential development of approximately 98.5 hectares of land that is identified as growth precinct 5 within the Ballan Framework Plan at Clause 11.01-1L-03 (11.01 (planning.vic.gov.au)) of the Moorabool Planning Scheme. The subject land is bounded by the Western Freeway (northern extent), Geelong-Ballan Road (western extent), Old Melbourne Road (southern extent) and the Werribee River (eastern extent). 

The amendment proposes to: 

  • Rezone the subject land from Rural Living Zone (RLZ) to Neighbourhood Residential Zone Schedule 10 (NRZ10);  

  • Apply the Development Plan Overlay Schedule 9 (DPO9) to the subject land;  

  • Apply the Vegetation Protection Overlay Schedule 2 (VPO2) to remnant native vegetation on the subject land and adjoining road reserves;  

  • Apply the Environmental Audit Overlay (EAO) to 5580 Geelong-Ballan Road, Ballan; and  

  • Remove the Design and Development Overlay Schedule 2 (DDO2) from the subject land. 

The amendment was exhibited from 24 January 2025 to 3 March 2025 and 68 submissions were received. At the Ordinary Meeting of Council on 7 May 2025, Council resolved to request the Minister for Planning appoint an Independent Planning Panel to consider the amendment and all submissions received.

 

A Planning Panel Hearing was held from 23 July to 31 July 2025 where submissions to the Amendment C108 Ballan Precinct 5 were heard.   

The report of the independent Planning Panel appointed to consider the amendment and submissions was released in September 2025.

On 17 December 2025, Council considered the findings of the Panel and resolved to:

  • Consider the planning panel’s report and accept the panel’s recommendations in relation to Moorabool Planning Scheme Amendment C108moor pursuant to Section 27 of the Planning and Environment Act 1987.
  • Adopt Moorabool Planning Scheme Amendment C108moor, in accordance with documents included in the attachments to the Council report, pursuant to Section 29 of the Planning and Environment Act 1987
  • Submit the adopted amendment, together with the prescribed information, to the Minister for Planning for approval, pursuant to Section 31 of the Planning and Environment Act 1987
